Fehuflow Terms of Service

1. Definitions


Term

Meaning

“Fehuflow,” “we,” “our,” “us”

Fehuflow LLC, an AI‑automation solutions provider.

“Service”

Any website, application, workflow, API endpoint, or other product or feature we make available that incorporates or exposes Fehuflow’s AI capabilities.

“AI Output”

All text, images, data, or other materials generated by the Service.

“User Content”

Data, prompts, instructions, files, or other materials a user submits to the Service.

“User‑Provided Data”

Any Personal Data contained in User Content.

2. Disclaimer of Accuracy & Reliability

  1. Nature of AI‑Generated Content – AI Output is produced by probabilistic models and is provided “AS IS” and “AS AVAILABLE.”

  2. No WarrantyTo the fullest extent permitted by law, Fehuflow disclaims all warranties—express, implied, statutory, or otherwise—including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement. We do not guarantee that AI Output will be accurate, complete, reliable, error‑free, or suitable for any particular use.

3. Use at Your Own Risk

  1. User Responsibility – You must independently verify AI Output before relying on it.

  2. No Professional Advice – AI Output is not a substitute for professional advice (legal, medical, financial, etc.). Always consult a qualified professional where appropriate.

4. Intellectual‑Property Rights & License

  1. Ownership – As between you and Fehuflow, you retain all rights in your User Content. Fehuflow and its licensors retain all rights in the Service and underlying models.

  2. License to Fehuflow – You grant Fehuflow a worldwide, non‑exclusive, royalty‑free license to use User Content solely to operate, maintain, and improve the Service.

  3. License to You – Subject to these Terms, Fehuflow grants you a limited, non‑exclusive, non‑transferable license to use, reproduce, and display AI Output for any lawful purpose.

  4. Aggregate Data – Fehuflow may use de‑identified, aggregated information derived from User Content and usage logs to improve the Service.

5. Limitation of Liability

  1. Cap on LiabilityIn no event will Fehuflow’s total liability exceed (a) the fees you paid to Fehuflow for the Service in the twelve (12) months preceding the claim or (b) US $10,000—whichever is less.

  2. Exclusion of Damages – Fehuflow is not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from or relating to the Service, even if we have been advised of the possibility of such damages.

  3. Jurisdictional Limits – Some jurisdictions do not allow the exclusion of certain warranties or the limitation/exclusion of liability. In such cases, Fehuflow’s liability will be limited to the maximum extent permitted by law.

6. Indemnification

You agree to indemnify, defend, and hold harmless Fehuflow and its officers, directors, employees, and agents from any claim, demand, lawsuit, or proceeding (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service, (b) your breach of these Terms, or (c) your provision or distribution of AI Output to third parties.

Procedure – Fehuflow will promptly notify you of any claim, you will have sole control of the defense and settlement (subject to Fehuflow’s prior written consent for settlements imposing liability on Fehuflow), and Fehuflow will provide reasonable assistance at your expense.

7. Acceptable Use Policy

You must not use the Service to:

  • Violate any law or regulation.

  • Generate or disseminate content that is hateful, harassing, violent, or discriminatory.

  • Facilitate illegal activities, including fraud, malware, or the exploitation of minors.

  • Disclose personal data without consent or scrape personal identifiers.

  • Infringe intellectual‑property or other proprietary rights.

Fehuflow reserves the right to suspend or terminate accounts that violate this policy

8. Privacy & Data Protection

Data Handling – Fehuflow collects only the data necessary to operate and secure the Service (e.g., audit logs, usage metadata). We do not use User‑Provided Data to train AI models.

  1. Security – We maintain administrative, technical, and physical safeguards designed to protect User‑Provided Data.

  2. Data Subject Rights – If you are in a jurisdiction granting privacy rights (e.g., GDPR, CCPA), you may submit requests to access, correct, or delete your Personal Data via support@fehuflow.ai.

  3. Third‑Party Processors – When we rely on upstream providers (e.g., OpenAI API), we are not responsible for User-Provided Data. Please refer to the third-party consumer privacy policies for how your data is handled.

9. Modifications & Updates

  1. Changes to the Service – Fehuflow may modify, suspend, or discontinue the Service or any feature at any time without liability.

  2. Changes to the Terms – We may update these Terms by posting a revised version and providing clear notice (e‑mail or in‑app). Updates take effect thirty (30) days after notice. Continued use of the Service constitutes acceptance of the revised Terms.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Oklahoma, USA, without regard to its conflict‑of‑laws rules. All disputes shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will take place in Edmond, Oklahoma, USA. Either party may seek injunctive relief in any court of competent jurisdiction.

11. Miscellaneous

Severability – If any provision is held unenforceable, the remaining provisions will remain in effect.

  • Force Majeure – Neither party is liable for delays or failures caused by events beyond its reasonable control.

  • Assignment – You may not assign these Terms without Fehuflow’s written consent. Fehuflow may assign them in connection with a merger, acquisition, or asset sale.

  • Entire Agreement – These Terms constitute the entire agreement between you and Fehuflow regarding the Service and supersede all prior agreements.

  • Survival – Sections 2, 3, 4, 5, 6, 10, and 11 survive termination.

12. Acknowledgment & Acceptance

By accessing or using the Service, you (a) acknowledge that you have read and understand these Terms, (b) agree to be bound by them, and (c) represent that you have the authority to enter into this agreement on behalf of yourself or the entity you represent.
